Protected species: which ones live on the site, and what the law asks

Before a project, we tell you which protected and threatened species live on and around the site: from the European and IUCN databases on the platform, then confirmed in the field by our ecologists and sensors. If the project touches them, the derogation is requested from the authority by whoever signs it, with our data.

The rule

Strict protection, and derogations only on conditions

Article 12 of the Habitats Directive strictly protects the animal species of its Annex IV: no deliberate capture or killing, no deliberate disturbance during breeding, rearing, hibernation and migration, no deterioration or destruction of breeding sites and resting places. The Birds Directive protects all wild birds, their nests and their eggs (Article 5). A derogation is possible only without a satisfactory alternative, without harming the conservation status of the population, and for the reasons the directives list (Habitats Directive Article 16, Birds Directive Article 9). In Italy, Presidential Decree 357/1997 protects the species in Article 8 and entrusts derogations to the Ministry of the Environment in Article 11.

  1. 1

    Which species

On the platform: the protected and threatened species of the European Environment Agency's database and of the IUCN Red List, on and around the site.

  2. 2

    Present or not

In the field: the survey and the sensors confirm which ones are really there, and where they breed and rest.

  3. 3

    If the project touches them

Avoid first. If the effect remains, the developer asks the authority for a derogation, with the data of the first two steps.

What we give you

The species, their status and where they are

The platform tells which protected and threatened species are recorded around the site; the field tells which ones are there.

Covered

  • The protected and threatened species recorded on and around the site, from the European Environment Agency's species database, with their IUCN risk class
  • The species list of a site cross-referenced with the IUCN Red List: for Argor-Heraeus, on a mining site of its supply chain in Colombia, 25 species endangered, vulnerable or near threatened in the area of analysis
  • Confirmation in the field by our ecologists: in spring 2026 the Italian crested newt, in Annexes II and IV, in the wetlands of an estate in Tuscany
  • Birds of Annex I of the Birds Directive, recorded continuously by Birdy
  • Breeding sites mapped with their position: the wetlands where the amphibians breed

In part

  • Bats: night activity yes, recorded by Kiro sensors still in field trials; species no
  • Matching the species with the annexes for the site: done by our ecologists, not yet automatic

Stays with the developer and the authority

  • The derogation request and its signature
  • The authorisation: in Italy the Ministry of the Environment grants it (Presidential Decree 357/1997, Article 11)
  • Captures and handling during the surveys: they need their own authorisation before the visit

Before the layout

The first answer is where not to build

A derogation is granted only when there is no satisfactory alternative. So the first use of the species list is the layout: knowing early where the breeding sites and resting places are lets the project keep away from them, and keeps the derogation for what cannot be avoided.

FAQ

Questions on protected species

Do you write the derogation request?

We give the request its data: which protected species are there, where they breed and rest, how the project affects them. The request is signed by the developer's professional and decided by the authority.

Where does the list of protected species come from?

From the European Environment Agency's species database and the IUCN Red List, for the site and the area around it, on the platform; then from the field, where our ecologists and sensors confirm which species are really there.

Are birds protected too?

All wild birds are, under Article 5 of the Birds Directive: no deliberate killing or capture, no destruction of nests and eggs, no deliberate disturbance during breeding and rearing where it matters. Birdy records the species on the site continuously.
